TERMS AND CONDITIONS OF PROPERTY INSPECTION SERVICES漢語
Purpose
The property inspection was requested by the Client (the one who paid for the home inspection services, a potential home buyer, a home owner or a designer/agent). The purpose of the inspection is to assess the current physical condition, during the time of inspection, of the premises. Daniel Leung Building Inspection Services (Daniel Leung Building Inspection Services and/or the inspector) is not responsible for any previous, present, and future defects of the inspected property.
 
Building Codes
The inspection shall not be construed as a compliance inspection of any governmental or non-governmental codes or regulations.
Confidentiality
Daniel Leung Building Inspection Services agrees to keep confidential and not to disclose to any person or entity, without the prior consent of Client, any information related to this inspection. Client agrees that the technical and pricing information contained in any proposal or report submitted by Daniel Leung Building Inspection Services is to be considered confidential, and shall not be released or otherwise made available to any third party without the express written consent of Daniel Leung Building Inspection Services.
 
Consequential Damages
The Client shall not be liable to Daniel Leung Building Inspection Services and Daniel Leung Building Inspection Services shall not be liable to the Client for any consequential damages incurred by either due to the fault of the other, regardless of the nature of this fault, or whether it was committed by the Client or Daniel Leung Building Inspection Services. Consequential damages include, but are not limited to, loss of use and loss of profit.
Cost Estimate
The cost estimate for repair work is given upon request. It is only for the Client's reference and should be confirmed by the appropriate qualified contractors. Daniel Leung Building Inspection Services cannot guarantee the accuracy of his opinions of cost, and in recognition of that fact, The Client waives any claim against Daniel Leung Building Inspection Services relative to the accuracy of Daniel Leung Building Inspector Services' opinion of estimated cost.
 
Fee
The fee for home inspection carried out by Daniel Leung Building Inspector Services constitutes payment for Daniel Leung Building Inspection Services' opinion of the property inspected and the inspection report. The Client will pay the property inspector the agreed fee immediately upon completion of the inspection.
Holding Inspector (Daniel Leung Building Inspection Services) Harmless
The Client understands that "Holding Inspector (Daniel Leung Building Inspection Services) Harmless" would, among other things, require the Client to compensate Daniel Leung Building Inspection Services for any time spent or expenses incurred by Daniel Leung Building Inspection Services in defence of any claim for which the Client has agreed to indemnify Daniel Leung Building Inspection Services, and that such compensation will be based upon Daniel Leung Building Inspection Services' prevailing fee schedule and expense reimbursement policy.
 
Information Provided by Others
Daniel Leung Building Inspection Services shall indicate to the Client the information needed for its rendering of services, and the Client shall provide to Daniel Leung Building Inspection Services such information as is available to the Client. The Client recognises that it is impossible for Daniel Leung Building Inspection Services to assure the sufficiency of such information, either because it is impossible to do so or because of errors or omissions, which may have occurred in assembling the information. Accordingly, the Client waives any claim against Daniel Leung Building Inspection Services, and agrees to defend, indemnify and hold Daniel Leung Building Inspection Services harmless from any claim or liability for injury or loss allegedly arising from errors, omissions, or inaccuracies in documents or other information provided to Daniel Leung Building Inspection Services by the Client. Further, the Client agrees to compensate the Inspector for any time spent or expenses incurred by Daniel Leung Building Inspection Services in defence of any such claim, with such compensation to be based upon Daniel Leung Building Inspection Services' prevailing fee schedule and expense reimbursement policy.
Inspection
The inspection is not intended to be technically exhaustive but will be a visual one, such as can be made from ground level and from floor levels of those parts of the property, which are safely and readily accessible. Unless otherwise stated, no parts of the structure or woodwork, which are covered, unexposed or inaccessible, will be inspected, and no report can be made as to whether or not such parts of the property are free from defect. Further, any items that are not discussed in this report or not included in the Records of Visual Inspection Sheets are either excluded from the scope of this inspection, or are not applicable/not accessible.
 
Limitation of Liability
The Client agrees to limit Daniel Leung Building Inspection Services' liability to the Client and all third parties arising from the inspector's professional acts, errors or omissions, such that the total aggregate liability of Daniel Leung Building Inspection Services (and inspector) to all those named shall not exceed the total fee for the inspection services rendered.
Limits of Accuracy and Thoroughness
The remarks and recommendations made by the property inspector, based on his observations and information available to him, which are assumed to be true and correct are the personal opinions of the inspector as of the inspection date, and do not constitute warranties of any type or kind, express or implied. It is to be understood that the property inspection serves to estimate the physical condition of the subject property and recommend further improvements of its various components. Such estimates serve as guides only and are subject to honest errors in judgement and non-discoverable latent defects. Daniel Leung Building Inspection Services is not responsible for any hidden defects, defects missed due to time limitations, defects of areas not covered by the inspection, for the condition of the property nor for any predictions made regarding the subject property. Every inspection is different with more time and emphasis placed on some areas than on others as determined by the inspector during the inspection and the questions and concerns of the Client. Therefore the accuracy and thoroughness of the inspection may vary to each different inspection.
 
Local
Any comments on the structural integrity and the functional efficiency of any improvements are based on the assumption that such improvements were designed and built according to the standards and practices in effect in the general region where they are located, unless otherwise noted. No prediction of their performance during extreme natural events can be made, this includes, but not limited to, hurricane force winds and rainstorms, extreme freezing conditions, earthquakes, etc.
Professional Standards and Ethics
The inspection services of Daniel Leung Building Inspection Services shall in all cases be rendered in accordance with prevailing professional standards and ethics, as well as certain laws or regulations that apply specifically to the inspector and/or technologist.

Right of Entry
The Client shall provide for Daniel Leung Building Inspection Services the right of access to the property to be inspected in order for Daniel Leung Building Inspection Services to fulfil the scope of services. The Client understands that the use of exploration equipment may cause some damage, the correction of which is not part of this inspection service. Client also understands that the discovery of certain conditions and/or taking preventive measures relative to these conditions may result in a reduction of the property's value. Further, Daniel Leung Building Inspection Services is not responsible for any loss of household articles or property during inspection. Accordingly, the Client waives any claim against Daniel Leung Building Inspection Services, and agrees to defend, indemnify and hold Daniel Leung Building Inspection Services harmless from any claim or liability for injury or loss allegedly arising from procedures associated with exploration activities or discovery of hazardous materials or suspected hazardous materials. In addition, the Client agrees to compensate Daniel Leung Building Inspection Services for any time spent or expenses incurred by Daniel Leung Building Inspection Services in defence of any such claim, with compensation be based upon Daniel Leung Building Inspection Services' prevailing fee schedule and expense reimbursement policy.
Right of Photography
The Client shall provide for Daniel Leung Building Inspection Services the right of taking photograph in the property to be inspected in order for Daniel Leung Building Inspection Services to fulfil the scope of services. The client may be obtained the right from the owner of the property owner before the inspection. The client agrees to protect the privacy for the owner of the property not to circulate or publicity the inspection report with colour photos in any form without written permission from the owner.
 
Standard of Care
The services performed by Daniel Leung Building Inspection Services in this inspection will be conducted in a professional manner consistent with that level of care and skill ordinarily exercised by members of the profession currently practising in the same locality under similar conditions. No other representation, express or implied, and no warranty or guarantee is included or intended in this inspection service, or in any report, opinion, and document or otherwise.
Testimony
Daniel Leung Building Inspection Services and the inspector are not required to give testimony or attendance in court or in any board/committee of any kind in regard to this inspection or report. If this is required, special arrangement has to be made with Daniel Leung Inspection Services and appropriate fees will be charged.
 
Third Party Exclusion
This inspection service shall not create any rights or benefits to parties other than the Client and Daniel Leung Building Inspection Services, except such other rights as may be specifically called for herein.
Time for Enquiry
Any items written in the report or discussed at the time of the inspection, which are not understood, should be discussed with the inspector as soon as possible after the inspection and/or after the report is received. If Daniel Leung Building Inspection Services does not hear from the Client within one month of receiving the report, it will be assumed that all the contents of the report are understood and accepted. Any enquiry made after this period may be subject to additional consultation fees, which will be based upon Daniel Leung Building Inspection Services' prevailing fee schedule and expense reimbursement policy.
 
Title
The title of the property, and the legalities of any building improvements, alterations, additions, etc. will not be investigated and will not be warranted with this report. No enquiries will be made regarding uses or potential uses of other property in the area, which could adversely affect the value or living conditions of the inspected property.
